Triage Staffing Data Breach Settlement: Key Details and Compensation Options
In May 2025, Triage Staffing (Triage LLC) experienced a data breach in which cybercriminals potentially accessed sensitive personal information, including names, addresses, dates of birth, and Social Security numbers. The incident led to a class action lawsuit alleging the company failed to adequately protect affected individuals’ data, exposing them to risks of identity theft and fraud.
Triage Staffing has agreed to a settlement to resolve the claims without admitting wrongdoing. U.S. residents who received a breach notification from the company may qualify for compensation under the settlement terms.
Eligibility and Compensation Options
Class members can choose from the following benefits:
- Ordinary losses (up to $500): Reimbursement for documented out-of-pocket expenses incurred between May 2025 and August 10, 2026, such as credit monitoring fees, credit freezes, ID replacement costs, and postage for financial institution communications.
- Extraordinary losses (up to $2,500): Compensation for documented identity theft or fraud losses directly linked to the breach, provided the claimant took steps to prevent or recover the losses (e.g., insurance claims).
- Alternative cash payment ($50): A one-time payment for those who do not claim ordinary or extraordinary losses.
- Credit monitoring services: Two years of CyEx Identity Defense Total, including $1 million in identity theft insurance, real-time credit monitoring, dark web scanning, and fraud resolution support.
How to File a Claim
Eligible individuals must submit a claim online or via mail/email using the unique ID and PIN from their settlement notice. Supporting documentation (receipts, bank statements, police reports) is required for ordinary and extraordinary loss claims. Payments will be distributed via PayPal, Venmo, Zelle, or paper check.
Settlement Fund Allocation
The settlement fund will cover:
- Settlement administration costs (to be determined)
- Attorneys’ fees (up to $240,000)
- Service awards for class representatives (up to $2,500 each)
- Credit monitoring services (cost based on claims filed)
- Payments to approved claimants (total dependent on claims filed)
Key Deadlines
- Opt-out deadline: July 10, 2026
- Claim filing deadline: August 10, 2026
- Final approval hearing: August 18, 2026
Payments will be issued after claim processing and final court approval. The settlement resolves allegations that Triage Staffing’s security failures led to the breach, though the company denies any wrongdoing.
