Mason Construction Data Breach Settlement Offers Compensation for Affected Individuals
In January 2024, Mason Construction LLC experienced a cyberattack in which an unauthorized user accessed sensitive personal data, including names, Social Security numbers, driver’s license numbers, financial information, and medical and health insurance details. The company has since agreed to a class action settlement to resolve allegations that it failed to adequately protect this information.
Eligibility and Compensation
U.S. residents who received a notice from Mason Construction about the breach may qualify for compensation. The settlement provides multiple payment options:
- Ordinary losses: Up to $500 for documented out-of-pocket expenses (e.g., credit monitoring fees, ID replacement, postage).
- Extraordinary losses: Up to $5,000 for identity theft or fraud losses, provided they can be linked to the breach.
- Lost time: Up to $75 ($25/hour for up to three hours) for time spent addressing the incident.
- Alternative cash payment: A one-time $55 payment without documentation.
- Credit monitoring: Two years of CyEx Identity Defense Complete, including $1 million in identity theft insurance and dark web monitoring.
Claim Process and Deadlines
Affected individuals must file a claim by June 1, 2026, using their unique ID and PIN from the settlement notice. Proof of expenses is required for ordinary and extraordinary loss claims, while lost time and alternative cash payments only require an attestation. Payments will be distributed via PayPal, Venmo, Zelle, or check after final court approval.
Settlement Fund Allocation
The settlement fund covers administration costs, $250,000 in attorneys’ fees, $2,500 service awards for class representatives, and remaining funds for claimant payouts. The final approval hearing is scheduled for June 4, 2026.
Mason Construction denies wrongdoing but settled to avoid further litigation. The breach highlights the risks of inadequate data protection in the construction sector.
