Lakeview Health Data Breach Settlement Offers Compensation to Affected Individuals
A class action settlement has been reached following a January 2024 cyberattack on Lakeview Health Systems LLC, which exposed sensitive personal and health information, including names, addresses, Social Security numbers, and medical records. The breach was discovered on or around January 25, 2024, prompting a lawsuit alleging inadequate security measures by the healthcare provider.
Eligibility and Compensation
U.S. residents whose personally identifiable or protected health information was compromised in the breach may file claims for financial reimbursement. The settlement offers multiple payout options:
- Ordinary losses (up to $2,000): Reimbursement for documented out-of-pocket expenses, such as credit monitoring fees, ID replacement costs, and postage, incurred between January 25, 2024, and August 24, 2026.
- Extraordinary losses (up to $5,000): Compensation for documented identity theft or fraud losses linked to the breach, provided they are not already covered under ordinary losses.
- Lost time (up to $80): Reimbursement for up to four hours of time spent responding to the breach at $20 per hour.
- Alternative cash payment (estimated at $50): A one-time payment for those who do not claim other benefits, with the final amount determined by the total number of claims.
- Credit monitoring: One year of CyEx Medical Shield Total services, including $1 million in medical identity theft insurance and fraud resolution support.
Claim Process and Deadlines
Affected individuals must file claims by August 24, 2026, either online or via mail/email to the settlement administrator. Required documentation includes a unique ID and PIN from the settlement notice, along with proof of expenses for ordinary and extraordinary losses. Payments will be issued via PayPal, Venmo, Zelle, or paper check after final court approval, expected by late 2026.
Settlement Fund Allocation
The settlement fund covers administration costs, up to $250,000 in attorneys’ fees, $7,500 in service awards for class representatives, and payments to approved claimants. The final payout amounts will depend on the number of claims filed.
Lakeview Health denied the allegations but agreed to settle to avoid prolonged litigation. The final approval hearing is scheduled for October 8, 2026.
