Eisner Advisory Group Settles $1.05M Data Breach Class Action
EisnerAmper LLP and Eisner Advisory Group LLC have agreed to a $1.05 million settlement to resolve a class action lawsuit stemming from a data breach that exposed the personal information of approximately 82,459 individuals between September 4 and 9, 2023. The breach compromised sensitive data, including names, Social Security numbers, financial account details, dates of birth, and medical and health insurance information.
The lawsuit alleged negligence, breach of contract, breach of fiduciary duty, unjust enrichment, and violations of the California Consumer Privacy Act (CCPA). While Eisner denies the allegations, the settlement avoids prolonged litigation.
Eligibility & Payouts
Affected individuals those who received a breach notification can file claims for:
- Up to $5,000 in reimbursement for documented out-of-pocket losses (e.g., fraud, identity theft, credit monitoring, or professional fees).
- A pro rata cash payment (estimated at $100) from the remaining settlement fund.
- An additional $50 for California residents under CCPA claims.
- Two years of single-bureau credit monitoring and $1 million in identity theft insurance.
Claim Process & Deadlines
Claims must be submitted online or via mail by October 8, 2026, using the claim ID and PIN from the settlement notice. Approved payments will be issued within 60 days of final approval (scheduled for October 12, 2026) or 21 days after claim approval, whichever is later.
The $1.05 million fund covers settlement administration, attorneys’ fees (up to $350,000), service awards for class representatives (up to $2,500 each), and credit monitoring costs, with the remainder distributed to claimants.
