Cardiovascular Consultants Ltd. has agreed to a $3.85 million settlement to resolve a class action lawsuit stemming from a 2023 data breach that exposed sensitive personal and health information of thousands of U.S. residents. The breach, discovered in September 2023, potentially compromised data including names, Social Security numbers, addresses, medical records, and insurance details.
Eligibility & Compensation
Individuals who received a breach notification from Cardiovascular Consultants may qualify for compensation, including:
- Up to $5,000 for documented out-of-pocket losses (e.g., identity theft, credit monitoring, or fraud-related expenses).
- An estimated $75 pro rata cash payment, subject to adjustment based on claim volume.
- Two years of medical monitoring services, though the duration may be reduced to one year if funds are insufficient.
Payments will be distributed after final court approval, expected following the August 18, 2026, hearing. Claims must be submitted by July 1, 2026, with opt-outs due by June 1, 2026.
Settlement Fund Allocation
The $3.85 million fund covers:
- Notice and administrative costs.
- Up to $1.28 million in attorneys’ fees.
- $20,000 in service awards for class representatives.
- The remaining balance for claimant payouts and medical monitoring.
While Cardiovascular Consultants denies wrongdoing, the settlement aims to avoid prolonged litigation and provide restitution to affected individuals. Payments will be issued via electronic transfer or mailed check, depending on the claim submission method.
