Eligibility & Compensation
Individuals in the U.S. or its territories who received a breach notification from Balance Autism may qualify for compensation. Claimants can receive:
- Up to $400 for documented out-of-pocket expenses (e.g., credit monitoring, legal fees).
- Up to $80 for lost time (up to four hours at $20/hour) spent addressing the breach.
- Up to $4,000 for extraordinary losses (e.g., fraud or identity theft) with proof of causation and efforts to mitigate damages.
- $50 as an alternative cash payment, no documentation required.
- Two years of one-bureau credit monitoring with $1 million in identity theft insurance.
Claim Process & Deadlines
Eligible individuals must submit a claim online or by mail, using the claim number and PIN from their notification. Required documentation varies by claim type, with a deadline of June 1, 2026. Payments will be issued after final court approval, following any appeals.
Settlement Fund Allocation
The $290,000 fund covers class member payments, up to $125,000 in attorneys’ fees, a $2,500 plaintiff service award, and administrative costs. The final approval hearing is scheduled for June 12, 2026.
